When someone has not made a Power of Attorney (either a Lasting Power of Attorney or the old style Enduring Power of Attorney), and they no longer have mental capacity to prepare the document, then an application must be to the Court of Protection to authorise someone else to make either financial or welfare decisions on their behalf. This person is called “a Deputy”.
